Who knew? It seemed, way back when, that Mitt Romney was a safe bet to make it to the dance with President Obama in November. Then Newt Gingrich came on like the bull terrier he is, followed by a surprising surge from Rick Santorum. If the seesaw ride continues, it could even make California's June 5 primary relevant for once. So whom do California conservatives like? My poll may have a wide margin of error, scientifically speaking, but I did zigzag my way through the heavily Republican Central Valley one day last week, asking that very question. "Gingrich," said Joe Rebella, owner of Fresno's Whirlwind Car Wash, where the sign says "you'll see a whirl of difference." Romney comes off as "wishy-washy," said the carwash man, who isn't exactly "conservative" with a capital C. He said he's voted for Democrats and Republicans, but business at the Whirlwind has been worse than ever since Obama took office. About a year ago, Rebella lost a big prize when Fresno City Hall stopped having him wash its fleet of cars because of budget troubles. OK, but given the GOP gospel of ever-smaller government, does Rebella really think he'd get the city fleet back under a President Gingrich? In the tiny farm town of Pixley, south of Tulare, I strolled into the True Romance Tattoo parlor, because how could I not? "I'm a convicted felon," said the owner, Josh Richardson, explaining why he won't be voting in June or November. But if he could, he'd definitely vote Republican, on gun-rights issues alone. OK, swell. His grandpa, James Crawford, said he had switched party affiliation from D to R that very morning because Obama is nothing but "promises, promises, promises." Crawford plans to vote for Romney in the primary because Gingrich is nothing but a politician and lobbyist. OK, but with so many people suffering through a rough economy, does it bother Crawford that the fabulously rich Romney said he didn't care about poor people, or that he paid 13.9% in taxes on dividends while lots of working folks paid twice as much? "No," said Crawford. "That's the way it's set up." More at that top link. That's interesting that folks are switching to Democrat affiliation at this late date. He's into the "evolving standards of decency" doctrine that's been used is left-wing decisions on the death penalty; and more importantly, Kennedy wrote the majority opinion in Lawrence v. Texas , which struck down sodomy laws in 2003. I'd have to research it, but the Court often hesitates to overturn state-level initiatives, arguing that the judgment of the Court can't be assumed superior to the voters in those states where a case originates. That said, here's David Savage, at Los Angeles Times , " Gay marriage fight may hinge on Supreme Court's Anthony Kennedy ": The Supreme Court has nine justices, but if the constitutional fight over same-sex marriage reaches them this year, the decision will probably come down to just one: a California Republican and Reagan-era conservative who has nonetheless written the court's two leading gay rights opinions. JusticeAnthony M. Kennedy, 75, often holds the court's deciding vote on the major issues that divide its liberals and conservatives. More often than not, that vote has swung the court to the right. But on gay rights, Kennedy has been anything but a "culture wars" conservative. One of his opinions lauded the intimacy between same-sex couples and demanded "respect for their private lives," provoking Justice Antonin Scalia to accuse him of having "signed on to the so-called homosexual agenda." "He is a California establishment Republican with moderately libertarian instincts," Stanford University law professor Pamela Karlan said of Kennedy. "He travels in circles where he has met and likes lots of gay people." Based on Kennedy's past opinions, Karlan is confident that if the Supreme Court takes up the issue of California's same-sex marriage ban, "it meansProp. 8is going down to defeat," she said. "There is no way he will take it to reinstate" the ban. Not all court observers share her prediction, but the uncertainty about how Kennedy might vote may, by itself, be enough to deter the high court from hearing an appeal of the decision by the U.S. 9th Circuit Court of Appeals. Four justices must vote for the court to consider a case, but a majority is needed to issue a ruling. When an appeal reaches the high court, the four most conservative justices will face a tough choice: Vote to have the court hear the case and run the risk that Kennedy would side with the more liberal justices to go beyond the 9th Circuit decision and establish a nationwide right to same-sex marriage. In response to my latest report, Casper continues to argue that nothing under the law prohibits him from his harassing contacts that I have repeatedly warned him not to make. See: " Update On Big Talking Harassment-Blogger Capt. Fogg of 'Human Voices' ." I am not linking to his harassment blog or to Capt. Fogg's. But Casper is arguing that the federal anti-harassment law requires either the distribution of pornography or anonymous contacts. That is not true. Federal statute 47 U.S.C. 223 prohibits anonymous harassment on the Internet and general harassment with the intent to annoy . As one writer indicates : Ok, let me put this in plain English for you, using the language of section 223 itself: Anybody who uses the Internet to post or email any comment, request, suggestion, proposal, image, or other communication which is obscene, lewd, lascivious, filthy, or indecent, with the intent to annoy, abuse, threaten, or harass another person has just committed a Federal crime, for which they can be imprisoned, fined, or both. By this definition, Casper's repeated indecent and harassing contacts directed to me against my wishes constitute a federal crime --- and this is why I will continue to repudiate Casper's criminal activities, and why I will not be bullied into silence or intimidated into withdrawal. This is bigger than this one progressive's attacks. Why on earth does Casper insist that he has a right to comment at the blog against my wishes, and why especially does he believe that he has a right to email me with malicious and annoying comments? The answer, of course, is that he's a progressive totalitarian. Progressives do not and will not tolerate difference, and that is what has been driving Casper since he became a troll stalker at this blog years ago. After I banned him he refused to stay away. And he and his allies have taken their malevolence to another level --- it's simply obscene what assholes like this think they can get away with and I refuse to be bullied. The man runs a hate blog pure and simple. I have reported him to the police. And as I noted by the officer, Casper's actions were indeed harassing and that such activities were possibly criminal actions under Section 653m of the California Penal Code. Now, since Casper has argued that he is not restrained by state law I have indicated I will take it to the federal level. I am researching my options under the law. I intend to show that Casper is harassing not only under Section 223 but that he may also be liable for federal civil rights violations. Casper's harassment could be driven by both ideological and racial bigotry. See the FBI's page, " Hate-fueled crimes are not just a thing of the past ." Casper has a long history as attacking me as "halfrican' and he's also routinely made disparaging remarks against people of color, indicating, for example, that he judges people first by their racial and ethnic identities, which is a form of racial profiling. And top of that, I've long documented the racist hatred that's routinely spewed in the comments at Casper's harassment blog. It's a vile repository of hate. It's simply amazing that a radical leftist purportedly committed to racial equality could in fact be so filled with racial hatred as this. But again, progressives are totalitarian and I'm more than ready to use their racial rights regime to stop their own hate and intimidation. So, all this is for the record. Walter James Casper III is on warning once again to stop the harassment. No one should be subject to that kind of hatred and campaigns of destruction simply for ideological disagreements. 		<description><![CDATA[ You may have issues with the current politicians in Washington, but at least, to our knowledge, none of them have ever been charged with murdering a lover 33 years ago. The Pittsburgh Tribune-Review reports that Bridgewater Councilman Gregory Scott Hopkins, a 65-year-old building contractor, has been charged with homicide of a young woman in 1979, thanks to a break-through in DNA evidence linking the legislator to the murder. "Councilman Gregory Scott Hopkins, 65, a building contractor, was charged with homicide because DNA evidence linked him to the slaying of Catherine Janet Walsh, 23, of Monaca, District Attorney Anthony J. Berosh said. Her father found her in her bed, bound and strangled with a bandana, on Sept. 1, 1979. Defense attorney James Ross said Hopkins is innocent, adding: 'We intend to fight (these charges) vigorously.' Police found DNA evidence on Walsh's nightgown, the white rope that bound her hands behind her back and the bedsheet that covered her body, according to the criminal complaint. New tests of the evidence established a link to Hopkins, prosecutors said. The complaint indicates that when police interviewed Hopkins seven hours after Walsh was found, he acknowledged that he and Walsh had been lovers but said that it had been a month since they had been intimate in her home." Residents of the small community of about 850 were reportedly shocked to hear the charges. "When I heard (about the arrest) on the news, it shocked me. I couldn't believe it," said one of Hopkins' neighbors, Tim Phillippi to the Tribune. "I always thought he was a real nice guy. I never in a million years would have thought this." Rod Weaver, who lives next door to Hopkins, said the councilman "was always very friendly to me. I would see him in the backyard and he would say, 'Hi! How are you doing?' We never had any problems." Hopkins is a Republican and was appointed to the borough council in 2010. A federal grant in 2010 gave troopers the money to resubmit evidence from this and other cases for DNA analysis, which wasn't available in 1979. The Tribune reports that Andrew J. Gall Jr., who was the first Monaca police officer to respond to Caltury's initial call and is now a county detective, spent hours tracking similar, unsolved murders around the country. Before the crime lab analysis was finished last week and warrant for Hopkins obtained Sunday, DNA samples were obtained for Hopkins and others -- some now living in Massachusetts, California and elsewhere -- who police interviewed initially about Walsh's murder. "Because of your dedication, professionalism and your relentless pursuit of justice, today has brought a measure of comfort, relief and satisfaction to our family," ABC News reports Walsh's brother, Francesco Caltieri, 52, said at a news conference Monday. Hopkins is being held in the Beaver County Jail without bond. A preliminary hearing is scheduled for Monday.]]></description>

POLITICO reports that the President's reelection campaign raised $40 million in the last three months  of 2011, ending the year with $82 million in the bank and $3 million in debt. A separate joint fundraising committee supporting Obama’s reelection and the Democratic National Committee,  reported  raising $24 million in the fourth quarter, spending $23 million and finishing the year with less than $1 million on hand. The Obama campaign also released a list of 450 major bundlers who combined to collect at least $74.4 million for his campaign and the DNC. Some on the list of big money bundlers live up to the stereotype from Obama's critics of who most supports the President; entertainment elites living in Hollywood and New York. Top fundraisers include movie producer Harvey Weinstein, DreamWorks CEO Jeffrey Katzenberg, Eva Longoria, gay power couple James Costas of HBO and former White House interior decorator Michael Smith, and Vogue editor-in-chief Anna Wintour. Wintour is the inspiration for Meryl Streep's character in The Devil Wears Prada. Shamed investor and former New Jersey Governor Jon Corzine was also on the list individuals having raised over $500,000 for the Obama campaign. Yet demand remains sky high as costs at four-year universities shoot upward and unemployed Californians seek retraining. Community college leaders say it has become necessary to ration classroom seats like water in a drought. They plan to impose statewide rules that prioritize students working toward a degree, certificate or basic academic skills. To meet that end, students who make little progress or take classes for enrichment purposes will move to the back of the line. The hope, says California Community Colleges Chancellor Jack Scott, is that new students won't get locked out. State leaders want to increase the percentage of students who graduate or transfer to universities, rates that suffer when students can't register for classes. "It was never my wish to ration attendance at community colleges, but this was forced upon us by the very severe budget cuts," Scott said. 		<description><![CDATA[ **Written by Doug Powers Late last year it was reported that California&#8217;s high speed rail project wouldn&#8217;t be completed for 22 years and would end up costing about $100 billion , which is three times the initial estimate. The project received over $2 billion from the stimulus. Gov. Jerry Brown now says the cost won&#8217;t be nearly that much, because somehow carbon fees levied on businesses (some of which would no doubt flee the state) will fund a good portion of the construction: &#8220;It&#8217;s not going to be $100 billion,&#8221; the Democratic governor said on ABC 7&#8242;s Eyewitness Newsmakers program. &#8220;That&#8217;s way off.&#8221; Brown&#8217;s remarks come as his administration prepares revisions to the California High-Speed Rail Authority&#8217;s latest business plan. Brown is trying to push the project through an increasingly skeptical Legislature following a series of critical reports. &#8220;Phase 1, I&#8217;m trying to redesign it in a way that in and of itself will be justified by the state investment,&#8221; Brown said. &#8220;We do have other sources of money: For example, cap-and-trade, which is this measure where you make people who produce greenhouse gasses pay certain fees &#8211; that will be a source of funding going forward for the high speed rail.&#8221; Brown said, &#8220;It&#8217;s going to be a lot cheaper than people are saying.&#8221; Wait a minute. So if industry stops spewing greenhouse gases into the atmosphere right now (thereby of course saving the planet from global warming) there won&#8217;t be enough cap/trade money for the government to build the latest bankruptcy-inducing glimmer in Joe Biden&#8217;s eye? I&#8217;ve yet to hear a more convincing argument for going green. Not unlike the government taxing tobacco and using some of the money to pay for SCHIP , the &#8220;green&#8221; movement has developed a Catch-22 dependence the very things they seek to eliminate. So keep those smokestacks spewing filth and pay those carbon fees, California industry, because Moonbeam has a &#8220;green&#8221; rail system to pay for so the planet can be saved from global warming! At least it helps explain recent decisions like this . I&#8217;m amazed by a bureaucratic mindset that believes forcing a portion of the price tag of a bloated project onto select areas of the private sector will lower the cost to the government, and therefore the taxpayers.
