In a brief two-page order, the high court affirmed a Superior Court judge’s ruling, which struck Alejandrina Cabrera’s name from the March ballot in the town of San Luis. The case, which attracted international media attention, was closely watched because of possible legal repercussions for other border communities where Spanish predominates. Cabrera’s lawyers argued that the court should not set a standard for English and that the issue should be decided by San Luis voters. Cabrera acknowledged her English is weak, but said she knew enough of the language to represent San Luis. Almost 99% of the town’s residents are Latino, and Spanish is spoken virtually everywhere. For some reason, Walter James Casper III doesn’t think I’m serious here. In response to my latest report, Casper continues to argue that nothing under the law prohibits him from his harassing contacts that I have repeatedly warned him not to make. But Casper is arguing that the federal anti-harassment law requires either the distribution of pornography or anonymous contacts. That is not true. Federal statute 47 U.S.C. 223 prohibits anonymous harassment on the Internet and general harassment with the intent to annoy . As one writer indicates : Ok, let me put this in plain English for you, using the language of section 223 itself: Anybody who uses the Internet to post or email any comment, request, suggestion, proposal, image, or other communication which is obscene, lewd, lascivious, filthy, or indecent, with the intent to annoy, abuse, threaten, or harass another person has just committed a Federal crime, for which they can be imprisoned, fined, or both. By this definition, Casper’s repeated indecent and harassing contacts directed to me against my wishes constitute a federal crime — and this is why I will continue to repudiate Casper’s criminal activities, and why I will not be bullied into silence or intimidated into withdrawal. This is bigger than this one progressive’s attacks. Why on earth does Casper insist that he has a right to comment at the blog against my wishes, and why especially does he believe that he has a right to email me with malicious and annoying comments? The answer, of course, is that he’s a progressive totalitarian. Progressives do not and will not tolerate difference, and that is what has been driving Casper since he became a troll stalker at this blog years ago. After I banned him he refused to stay away. And he and his allies have taken their malevolence to another level — it’s simply obscene what assholes like this think they can get away with and I refuse to be bullied. Rising GOP star Sen. Marco Rubio (FL) gave an impressive speech on immigration Friday to the Hispanic Leadership Network conference, an event led by former Florida Governor Jeb Bush. The Miami Herald reports that Sen. Rubio’s “sweeping” immigration speech took swipes at both Republicans and Democrats for playing politics with an issue so crucial to hispanics, calling for a compassionate approach for dealing with the issue of illegal immigration. The presumptive top pick for running mate to any of the remaining Republican presidential candidates conquered an early challenge during his remarks, addressing a group of protesters at the event who stood and interrupted Sen. Rubio’s speech. “Let me tell you guys something; these young men and women raise a very legitimate issue,” Sen. Rubio said. “They came here to a crowd that they know might not be kind to their point of view on issues. And they had the bravery and the courage to raise their voices. I thank God I’m in a country where I can do that and I want them to hear what I have to say.” CBS Miami notes that in his speech, Sen. Rubio spoke of the main problem in immigration being how to balance and honor “our legacy of immigrants” with “our legacy as a nation of laws.” “It’s impossible to walk a block in Miami, in Los Angeles, San Antonio without running into someone who is being deeply impacted by a broken legal immigration system,” Sen. Rubio told the conference. Sen. Rubio had a message to fellow conservatives similar to comments he made earlier in the week when he denounced the language used an ad attacking Mitt Romney produced by the campaign of Newt Gingrich. “For those of us who come from the conservative movement, we must admit that there are those among us who have used rhetoric that is harsh and intolerable, inexcusable, and we must admit, myself included, that sometimes we’ve been too slow in condemning that language for what it is,” Sen.Rubio sad. “But at the same time, on the left there are those that are using this issue for pure politics creating unrealistic and unreasonable expectations among those in the Latino community across this country.” Sen. Rubio did not directly address the DREAM Act, but said that “there is broad support in America for the notion that for those children that were brought here at a very young age, by their parents through no fault of their own, who have grown up here their entire lives, and now want to serve in the military or are high academic achievers and want to go to school and contribute to America’s future, I think there is broad bipartisan support for the notion that we should somehow figure out a way to accommodate them. “Figure out a way to accommodate them in a way that does not encourage illegal immigration in the future.” Sen. Rubio’s remarks Friday have received acclaim from several media commentators. “GOP Golden Boy Marco Rubio revealed the magnitude of his star power today,” writes the Business Insider’s Grace Wyler. “Delivering an impassioned speech on immigration that showed exactly why he is the true heir apparent of the Republican Party.” “Senator Rubio did little to disappoint the party’s faithful,” FIU Professor Ediberto Roman writes in the Huffington Post . “He was indeed impressive. Whether his impressive approach elevates the conversation and results in change that benefits this country is, however, still an open question. Nevertheless, his poise was remarkable.” Fox News reports that even as Sen.Rubio called for a softer tone on immigration, he reiterated his emphasis for bi-partisan support for the need for a modernized system, a new Visa program, E-Verify, tougher border security and a functional guest worker program. “I challenge the Republican nominees and all Republicans to not just be the anti-illegal immigration party,” he said. “That’s not who we are and that’s not who we should be, we should be the pro-legal immigration party.” Here’s a transcript and video of Sen. Conservative radio-host Rush Limbaugh has joined several conservative commentators and politicians in the fallout following GOP presidential candidate Newt Gingrich’s remarks in regards to immigration during Tuesday’s CNN debate. The chatter in political media today has focused on Newt’s unexpected immigration proposal , which would allow illegal immigrants who have been in the U.S. for extended periods to obtain a legal status, though not full-scale citizenship. “If you’ve been here 25 years and you got three kids and two grandkids, you’ve been paying taxes and obeying the law, you belong to a local church, I don‘t think we’re going to separate you from your family, uproot you forcefully and kick you out,” Gingrich said Tuesday night. Rush opened his popular radio show today by discussing Gingrich’s remarks , and while calling the timing odd and details impractical, Limbaugh was still able to identify another candidate with a more questionable stance on immigration than the former speaker: “Newt’s position on illegal aliens, it was a little odd, and I’ll tell you why,” Limbaugh started. “It came outta nowhere. He had not built a foundation for it. This was the first that we had heard of it last night, and that’s not how major policy positions are adopted.” Limbaugh continued: “Now, I understand what he’s saying about somebody here with roots and family and all that, been here for a long period of time. But how exactly would this work? What if somebody’s been here not 25 years but 22? What if somebody’s been here 20, 17? Pick a number less than 25 but longer than five. What’s the cutoff here? He said 25 years. What if it’s 14? What if it’s 13? What if they don’t have a family but they have been hardworking and tax paying for 24 years? Just because somebody is here 25 years does not mean that they have assimilated into our society . It doesn’t necessarily mean that. They could be rabble-rousing for La Raza out there for 24 of the 25 years. Do they have to speak English, for example? What is the test here to determine that they have assimilated into our distinct American culture? This is a bold proposal. There’s no question. But it was snuck in there, a bold proposal that trickled into the debate. Now, this is just me. You might disagree with me, I doubt it, few of you ever do, but you might disagree with me here. Romney talked about citizenship for them. Newt’s the one taking the heavy fire today, but Romney mentioned citizenship on Meet the Press in 2007.” The “heavy fire” Rush is speaking of has been prevalent in the discussions on cable news programs Wednesday, as well as in several statements from other politicians. POLITICO reports that fellow GOP presidential candidate Michele Bachmann has “doubled down on her claim that Newt Gingrich wants to offer blanket immunity to all undocumented immigrants currently living in the U.S.” “He’s saying that all people who are here as illegal workers would be given that status, that’s over 11 million people who are here,” Bachmann said (on Fox News, ) When pressed that Gingrich had explained his position would only apply to those who had been here for ‘decades,’ Bachmann said his previous remarks have indicated he supports blanket amnesty. ‘That would be a contradiction of the statement that the speaker made earlier,’ she said. ‘That’s two different statements that the speaker is making.’” The Hill reports on influential Iowa Congressman Steve King’s denunciation of Gingrich’s remarks: “’I think if Speaker Gingrich had that to do over again, he might couch his language a little differently at a minimum. I wouldn’t agree with him on that policy,’ King said. ‘I think that when you give people even a promise that they can stay in the country after they’re here illegally you become more of a magnet and it is a form of amnesty and more people will come in counting on that.” King told O.Kay Henderson that the immigration remarks “makes it harder” to support Gingrich. Slate speculated that the remarks, and how Gingrich has defended them following the debate, “might remind people why Gingrich might not be a safe bet: He has a lot of ideas, and when he thinks he’s right, there’s no persuading him.” Gingrich has swung back some of the heat directed at him to Mitt Romney. Tweeting directly to Romney today in regards to the 2007 Meet the Press statements on immigration, Newt quips “Here’s a trip down memory lane,” followed by “So what’s your position on citizenship for illegals again? (I oppose it.)” The Washington Post reports that the Obama campaign “never misses an opportunity to portray Romney as inconsistent,” and held a conference call today to denounce Mitt’s immigration stance following Tuesday’s debate. The Post notes that the jump on Romney puts “the Democratic officials in the odd position of virtually endorsing Gingrich on the issue.” We will keep an eye on how immigration issues develop in the GOP primary.

On Tuesday , I gave you the sad news about the passing of Joey Vento. My column below pays tribute to a true American patriot and assimilation warrior. The 71-year-old owner of Geno’s Steaks died of a heart attack this week, but he reignited a national debate over radical multiculturalism that will burn for years to come. Five years ago, Vento garnered national headlines when a local newspaper profiled his outspoken views on customers who couldn’t speak English. He hung a sign in his order window that read: “This is America. When ordering, speak English.” Though he never turned anyone away, the grandson of Italian immigrants informed hungry patrons that he reserved the “right to refuse service” to those he couldn’t understand. No menus in 10 different languages. No dumbed-down pictographs for the idiocracy. The choice at Geno’s is simple: Sink or swim. Learn English or eat somewhere else. “If you can’t tell me what you want, I can’t serve you,” Vento told the Philadelphia Inquirer . “It’s up to you. If you can’t read, if you can’t say the word ‘cheese,’ how can I communicate with you — and why should I have to bend? I got a business to run.” Vento’s refusal to coddle triggered a tsunami of complaints from self-appointed civil rights leaders. The ululations of the aggrieved resounded from sea to whining sea. For exercising his constitutionally protected free speech, both the Philadelphia City Council and Philadelphia Human Relations Commission launched political inquisitions against Vento. Yes, it really happened in the home of Independence Hall. Members of the government bodies demanded that Vento remove his bald eagle-adorned sign and threatened to revoke his business license. After 21 months of investigation, a marathon seven-hour hearing and hysterical testimony likening his innocuous 4-inch-by-9-inch sign to “Jim Crow laws,” he was cleared of discrimination charges. Plainspoken as ever, Vento understood full well why the multi-culti mob wanted to gag him: “I say what everybody’s thinking but is afraid to say.” As a fellow Philly-born loudmouth, I cheered Vento on for years during his battles with the anti-assimilationists. He weathered the same old slings, arrows and accusations of being a “racist,” “xenophobe,” “nativist” and immigrant-basher — despite the fact that generations of assimilated immigrants and naturalized Americans agree with him. The vast majority of Americans support English as the official language of the United States. Latino parents in California revolted against “bilingual education” mandates that stuck their kids in Spanish-only classes. Generations of successful immigrant families in America know English is the language of success, not the language of oppression. Yet, politicians in both parties have pandered ceaselessly to the language-Balkanizers. The Clinton administration gave us Executive Order 13166 , effectively requiring all government agencies to provide translations into any language on demand. Rather than rescind the order, the Bush administration went after localities and forced them to provide foreign language materials . In 2004, the Bush administration ordered Harris County, Texas, to provide all voter registration and election information and supplies, including the voting machine ballot, in Vietnamese, as well as English and Spanish. Under the Obama administration, the Department of Justice threatened to cut off federal funding to the state of Oklahoma over a state constitutional amendment proposal to designate English as its official language. The Obama DOJ also has ordered my home state of Colorado to protect the interests of “language minority populations” by funding free translators for any foreigners — legal or illegal — who sue in civil cases here. In the same vein, the Philadelphia Human Rights Commission that tried to silence Vento distributes pamphlets asking “Are you a victim of discrimination?” in seven languages. “Progressive” politicians pandering for votes treat non-English speakers as hopeless victims of white hegemony, instead of beneficiaries of the American dream. By contrast, small-business man Joey Vento promoted a common culture, a common tongue and common sense.
