[caption id="attachment_230831" align="aligncenter" width="429" caption="Defense Secretary Leon Panetta (AP Photo/Pablo Martinez Monsivais)"] [/caption] SAN DIEGO (The Blaze/AP) -- Yesterday, the Blaze reported that the military "handled" a situation involving Marine snipers who posed with a logo resembling a Nazi symbol. But now, just a day after the initial report made its way around the blogosphere, news is breaking that Defense Secretary Leon Panetta has asked the Marine Corps to take another look at its investigation that concluded the men should not be disciplined. As we reported, Lt. Col. Stewart Upton initially said in a statement that the Marines' action was unacceptable. While no harsh penalties were paid by the soldiers involved, the sentiment was that, to a degree, the situation had been contended with. Apparently, verbal warnings, though, weren't enough. Pentagon press secretary George Little says that Panetta asked the Marine Corps Friday to look into the situation "and to take appropriate action." [caption id="attachment_240939" align="aligncenter" width="620" caption="This is the image that was posted on the Knight's Armament Blog"] [/caption] CNN reports that, following the initial discovery of the image, the Marines' commander decided not to proceed with disciplinary action. However, those individuals involved were told that such behavior wouldn't be tolerated and that punishment would result if, indeed, they partook in similar conduct again. So, while the men were "punished" in the sense of receiving a warning and clarification as a result of their actions, no official military retribution was doled out -- an action that is clearly now being revisited and reassessed. CNN continues : The Marine Corps said it became aware of the photo last November and investigated, but found it not to be racially motivated, according to a statement released by a Marine Corps spokesman, Lt. Col. Stewart Upton. "Those involved acknowledged that the symbol could be misinterpreted and is not in keeping with our Marine Corps ethos and values," the statement said. Little, speaking in Washington, says racist and anti-Semitic symbols have absolutely no place alongside U.S. service members. The Simon Wiesenthal Center, a Jewish human rights group, has demanded President Barack Obama order an investigation and hold the troops accountable.

Earlier today, The Blaze’s Billy Hallowell reported the following: This afternoon, President Obama announced the “accommodation” his administration plans to offer church-affiliated groups. Speaking from the White House, he explained that, under the new plan, universities and institutions connected with faiths that oppose contraception and associated services will not have to directly offer them. Obama said that the new-and-improved birth control, sterilization and abortion-inducing drug policy will protect religious liberties, while assuring women’s access to contraception reports the AP . And although major media outlets were calling the president’s decision a “cave,” some critics believe that he's simply applying the unconstitutional mandate to a different entity, namely, insurance companies. “Everybody's reporting that Obama's caving on this mandate that the Catholic services provide abortion and all. There's not a cave here!” conservative talk show host Rush Limbaugh said Friday afternoon. “There may be an accommodation, but there's no big cave-in here. It's still the government mandating this stuff happen. They're just changing the provider. It's not done by the church. He says he gave them a way out of it by mandating the insurance companies do it, but that's not the point here.” He continued: So everywhere I'm reading that Obama is caving on the mandate in Obamacare that Catholic churches -- well, not churches, but the schools and hospitals are mandated to provide contraceptives and abortion-related services that they religiously disagree with. "What's happened here is that Obama's caved! He has seen, he has heard, and now he's gonna shift that burden to the insurance companies!" … My point here is, ladies and gentlemen, we are losing freedom and liberty inch by inch. It's not being taken -- well, in some cases it is, but in most cases it's not being taken from us in giant grabs. It's little by little by little such that people don't even see it. It doesn't even register. Limbaugh then addressed an AP report that claimed religious employers would not have to cover birth control for their employees. "The administration instead will demand that insurance companies will be the ones directly responsible for providing free contraception," the AP reported. Limbaugh was beside himself. “And we're supposed to applaud this? We're supposed to think that we have emerged with a big victory here? Obama can mandate that we buy insurance, and now Obama can mandate what insurance companies must offer -- and after mandating what insurance companies must offer, then Obama can mandate what insurance companies can charge for it?” Limbaugh asked. So what was his take away from this supposed “cave”? “Freedom doesn't mean anything to this guy! Freedom doesn't mean anything to this regime or this administration. To me, this is breathtaking. This is an incredible sight to behold here,” Limbaugh said. “Since when does a president have the power to threaten to issue a rule gutting religious liberty? That's the first thing.” Limbaugh then went on to explain that he believes all of this “kerfuffle” between the Catholic Church and the Obama administration has been by design. “And, by the way, I don't think any of this a mistake. I don't think this religious kerfuffle is something that they overreached on,” Limbaugh explained. “I think roiling this country and distracting people, setting up these extreme things like this and then walking them back to create the illusion, ‘Okay, you know what? We're not gonna take your freedom,’ it's all BS, folks.” Hear Limbaugh explain the so-called "compromise" via Daily Rushbo : “So here we have again from the top,” Limbaugh continued, “Obama's gonna offer a compromise proposal said to be respectful of religious concerns. He started this. He started it by demanding that Catholic organizations provide birth control and other abortion-related services.” “That's unconstitutional. He cannot do it. There is an appropriate uproar. The regime says, ‘Okay, we'll walk it back and then we'll make the insurance companies do it.’ He's still getting everything he wants! He's getting mandated federal funding of abortion services -- and, in the process, trampling all over the Constitution. The right to religious liberty in this context is unequivocal in our country. It's in the Constitution!” Read the full transcript of Limbaugh’s opening monologue here.

Dr. Paul Kengor is professor of political science at Grove City College I’ve gotten some very interesting emails regarding President Obama’s mandate commanding Roman Catholics (and many evangelical Protestants) to violate their consciences by providing mandatory contraception, sterilization, and abortion-inducing pharmaceuticals. The emailers noted that Obama’s action will force Catholics to challenge the president in court, particularly given that bishops are saying they will not comply with the law. It could mean another constitutional showdown over “ Obama-care ,” one that could likewise end up in the Supreme Court. Imagine: “ The Catholic Bishops v. Obama .” What a fitting capstone to the Obama presidency . And imagine that a majority of professing Roman Catholics elected this man in November 2008 . If this issue goes to the high court, I wouldn’t bet my money on Obama, even with the two new “pro-choice,” pro- Roe liberals he added to the bench: Elena Kagan and Sonia Sotomayor. Even the most “progressive” Supreme Court justice cannot avoid that old freedom-of-religion thing in the First Amendment. All of that is remarkable enough. But I find it especially ironic given two other fascinating current news item relating to the Constitution: Last week, President Obama did an interview with NBC’s Matt Lauer. Obama expressed frustration at his inability to be the “transformational political figure” Americans elected. The “change agent” lamented that this was the fault of the American Founders—who Obama refers to as “men of property and wealth”—and their Constitution. Obama told Lauer: What’s frustrated people is that I have not been able to force Congress to implement every aspect of what I said in 2008. Well, it turns out our Founders designed a system that makes it more difficult to bring about change that I would like sometimes. But what I have been able to do is move in the right direction. And what I’m going to keep on doing is plot away, very persistent. Ah, that old Constitution again. Obama is quite correct. His primary obstacle is the Founders’ system of separation of powers and checks and balances. His problem is a Congress and Supreme Court that is empowered to say, “No, Mr. President, that isn’t constitutional. You can’t do that in America.” Well, Obama’s mandate to the Catholic Church could be the next such challenge, again impeding his self-perceived rise to transcendent political greatness. A Democrat-controlled Congress approved Obama-care, but the Supreme Court now must scrutinize its provisions. That’s the court’s duty. That brings me to the second news item: Supreme Court Justice Ruth Bader Ginsburg gave an interview to Egyptian television. Ginsburg will likely be the next justice to step down. Once Obama replaces her with a much younger pro- Roe judge, this nation will have Roe v. Wade for another 39 years. In the interview, Ginsburg advised Middle East democrats on drafting a constitution. She did not, however, recommend the U.S. Constitution. Ginsburg stated: I can’t speak about what the Egyptian experience should be, because I’m operating under a rather old constitution. The United States, in comparison to Egypt, is a very new nation; and yet we have the oldest written constitution still in force in the world… I would not look to the U.S. Constitution if I were drafting a constitution in the year 2012. I might look at the constitution of South Africa. That was a deliberate attempt to have a fundamental instrument of government that embraced basic human rights, and had an independent judiciary… It really is, I think, a great piece of work that was done. Much more recently than the U.S. Constitution, Canada has a Charter of Rights and Freedoms. It dates from 1982. You would almost certainly look at the European Convention on Human Rights. Yes, why not take advantage of what there is elsewhere in the world? Actually, why not take advantage of what’s in the U.S. Constitution? The paradox in Ginsburg’s statement is her dismissal of the U.S. Constitution because it’s “rather old;” in fact, “the oldest written constitution still in force in the world.” Well, why is it so old and still in force? Because it was done right. It is based on timeless values and virtues and universal rights that work; that are true. It has been amended less than 30 times in 220-some years. It is the most stable, successful, remarkable constitution in history, bringing together a vast array of peoples and assimilating them into history’s most prosperous, awe-inspiring nation—a nation that spent the 20th century winning freedom for other nations, so those nations could produce democracies and constitutions. The U.S. Constitution is the perfect model, at once both beautifully broad and specific. And among the things it got right are separation of powers and checks in balances. Ruth Bader Ginsburg and President Obama may be learning that again very soon—compliments of Obama-care and its constitutional assault on the consciences of religious believers. Dr. Paul Kengor is professor of political science at Grove City College, executive director of The Center for Vision & Values , and author of the newly released Dupes: How America’s Adversaries Have Manipulated Progressives for a Century . His other books include The Crusader: Ronald Reagan and the Fall of Communism and God and Ronald Reagan .
